
Context:
India has responded to U.S. investigations under Section 301 on issues of forced labour and excess manufacturing capacity, asserting that its legal framework complies with International Labour Organization (ILO) standards and that its export profile reflects a domestic demand-driven economy.
Section 301 (What & Why):
- Section 301 is part of the U.S. Trade Act of 1974, which allows the U.S. to investigate other countries for unfair trade practices.
- The U.S. uses this provision to protect its domestic industries and workers by taking action (like tariffs or restrictions) if it finds violations.
- Unfair practices may include: forced labour, intellectual property theft, excessive subsidies to domestic industries, market access restrictions, dumping (selling goods below cost), and discriminatory regulations against foreign companies.
Recent investigation:
- The U.S. has recently initiated a Section 301 probe into India’s labour practices and manufacturing policies, focusing on concerns related to forced labour and industrial overcapacity.
- International Labour Organization (ILO), established in 1919 and headquartered in Geneva, sets global labour standards.
- India has ratified key ILO conventions such as the Forced Labour Convention (1930) and Abolition of Forced Labour Convention (1957).
- Forced labour refers to work taken from individuals through coercion, threats, or without their free consent.
