Model Code of Conduct: Safeguarding Electoral Neutrality

Context: Several opposition parties have written to CEC alleging that recent PM Modi’s address to the nation violated the Model Code of Conduct (MCC) for elections and seeking action against him. The issue raises questions about electoral fairness, neutrality of the state, and level playing field during elections.

  • Democracy requires free and fair elections where all parties compete on an equal footing without misuse of state resources.
  • Model Code of Conduct (MCC) is issued by the Election Commission of India (ECI) to regulate conduct of political parties and governments during elections.
  • Once election schedule is announced, governments cannot use public funds for advertisements that favour the ruling party.
  • Government communication includes welfare awareness campaigns, official advertisements, SMS alerts, and digital outreach for public services.
  • Misuse occurs when official platforms are used to indirectly promote political leaders or parties.
  • In Common Cause v Union of India (2015), the Supreme Court framed guidelines to prevent misuse of government advertisements for political glorification.
  • Public funds are taxpayer resources and should be used for governance purposes, not partisan campaigning.
