Context:
India’s rapidly expanding digital consumer market is facing a significant threat from deceptive interface design practices known as dark patterns. A report by market research firm Datum Intelligence estimates that Indian online buyers are losing between Rs 25,000 crore and Rs 28,000 crore annually to such manipulative tactics. With 304 million online buyers, the scale of consumer harm demands urgent regulatory attention.
Explanation:
- Dark patterns are deliberately deceptive user interface designs on websites and apps that manipulate consumers into making unintended purchases, subscriptions or payments, exploiting cognitive biases rather than informing free choice.
- As per the report, 88% of India’s 304 million online buyers are affected, losing approximately Rs 78 to Rs 87 per month each through practices such as hidden charges, forced add-ons, drip pricing, false urgency cues and subscription traps.
- Drip pricing is a tactic where a product is advertised at an attractively low base price, but additional mandatory charges such as platform fees, convenience fees, taxes and handling charges are revealed gradually at each step of checkout, resulting in a final price significantly higher than what the consumer originally saw. By the time the full cost is visible, the consumer is psychologically committed to completing the purchase.
- Common dark pattern tactics also include false urgency (“only 2 left!”), forced add-ons (pre-ticked items added without consent), and subscription traps (easy sign-up but deliberately difficult cancellation).
- India’s Department of Consumer Affairs notified Guidelines for Prevention and Regulation of Dark Patterns in 2023 under the Consumer Protection Act, 2019, marking one of the earliest regulatory frameworks globally to specifically address dark patterns in e-commerce.
