Privilege Notice and Parliamentary Privileges (Source: The Hindu)

Context:

A privilege notice was moved in the Lok Sabha against the defence minister for allegedly misleading Parliament on Operation Sindoor casualties. The issue concerns whether inaccurate or withheld information to the House can amount to breach of parliamentary privilege.

Explanation:

  • Parliamentary privileges are special rights and immunities enjoyed by Parliament, its members and committees for the effective discharge of legislative functions.
  • They are provided under Article 105 for Parliament and Article 194 for State Legislatures.
  • Key privileges include freedom of speech in the House, immunity from court proceedings for parliamentary speech/vote, and the right of the House to regulate its internal proceedings.
  • A breach of privilege occurs when any act obstructs or lowers the authority, dignity or functioning of Parliament or its members.
  • Contempt of the House is wider than breach of privilege and includes acts that obstruct parliamentary work even without violating a specific privilege.
  • A privilege notice is a formal complaint by an MP alleging breach of privilege.
  • In Lok Sabha, such notices are examined under Rule 222/223 of the Rules of Procedure.
  • The Speaker decides whether the matter is admissible and may refer it to the Committee of Privileges.
  • Misleading Parliament may be treated seriously because ministerial responsibility requires truthful and complete information to the House.
