Context
The Supreme Court has reinforced safeguards against arbitrary arrest, holding that an arrested person must be meaningfully informed of the grounds of arrest. The ruling strengthens the protection of personal liberty and dignity under Articles 21 and 22 of the Constitution.
Explanation
- Article 21 guarantees life and personal liberty except according to procedure established by law, which must be just, fair and reasonable.
- Article 22(1) gives an arrested person the right to know the grounds of arrest and to consult and be defended by a legal practitioner.
- Article 22(2) requires production before the nearest magistrate within 24 hours, excluding journey time.
- Article 22 also contains provisions concerning preventive detention, which differs from punitive detention following an offence.
- In Arnesh Kumar v. State of Bihar (2014), the Supreme Court stressed that arrest should not be routine and its necessity must be justified.
- Maneka Gandhi v. Union of India (1978) linked Articles 14, 19 and 21, popularly called the Golden Triangle of fundamental rights.
- These safeguards seek to balance State police powers with individual liberty, dignity and procedural fairness.
