Context
The Union Ministry of Home Affairs (MHA) has extended the Armed Forces (Special Powers) Act, 1958 (AFSPA) in notified “disturbed areas” of Manipur, Nagaland and Arunachal Pradesh for another six months from 1 October 2026.
Explanation
- AFSPA, 1958 applies to areas formally declared “disturbed areas” because of insurgency or serious security concerns.
- Under Section 3, the Central Government or Governor of a State can declare an area disturbed.
- Armed forces may arrest without warrant, conduct searches without warrant and use force subject to conditions laid down in the Act.
- Under Section 6, prosecution or other legal proceedings against personnel for acts done under AFSPA require prior sanction of the Central Government.
- From October 2026, AFSPA covers most of Manipur except 13 police-station areas, nine Nagaland districts plus specified police-station areas, and Tirap, Changlang, Longding and specified areas of Namsai district in Arunachal Pradesh.
