Ambiguity in Definition: Left Wing Extremism is often used interchangeably with Maoism, but it is not clearly defined in the bill. Even the MHA lists banned organisations under UAPA but does not clearly define Left Wing Extremism as an ideology or activity.
Criminalizing Dissent:
- Anyone can be accused of Left Wing Extremism for possessing literature or supporting “left” ideas.
- It risks labelling dissenters or critics of the government as extremists.
- It leads to suppression of intellectual and ideological diversity.
- Concerns of Misuse: The state’s vague language could lead to harassment of civil society and misuse by law enforcement to punish ideological opposition.
- Duplication of Legal Provisions: India already has multiple laws (e.g., UAPA, IPC, other penal laws) to address violence and extremism. The new law duplicates existing provisions but adds executive discretion without judicial checks.

- Freedom of Speech and Expression: The most dangerous part of the bill is its potential to restrict Article 19(1)(a) (freedom of expression). It leads to restrictions which are unreasonable and non-arbitrary.
- Judicial Caution: Judiciary often upholds freedom but may defer to the government when “security” is cited. This creates space for vague and random application of laws.

The bill reflects a larger trend of using security discourse to undermine civil liberties.It’s essential for lawmakers and civil society to insist on legal clarity and protect constitutional freedoms.
