Supreme Court on AI-Generated Hallucinations in Judicial Proceedings (Source: The Hindu)

Context:

The Supreme Court set aside an NCLT order after finding that it relied on AI-generated fictitious case law. The Court emphasized a zero-tolerance approach towards unverified AI-generated legal material, stating that it undermines the integrity of the judicial process.

Explanation:

  • Judicial precedent means that courts follow binding decisions of higher courts to ensure consistency and certainty in law.
  • Generative AI creates new content, including text, images and code, using Large Language Models (LLMs) trained on vast datasets.
  • AI hallucination occurs when an AI system generates false, fabricated or non-existent information while presenting it as factual.
  • In legal contexts, hallucinations may produce fictitious judicial precedents, statutes or citations, leading to serious judicial errors.
  • Verification, human oversight and fact-checking are essential before relying on AI-generated outputs in judicial or administrative decision-making.
  • AI can assist in legal research, document review, translation and case management, but it cannot replace judicial reasoning or independent legal verification.
  • Responsible AI use in governance is guided by principles of transparency, accountability, fairness, reliability and human oversight.
  • The National Company Law Tribunal (NCLT) is a quasi-judicial body in India that adjudicates issues relating to Indian companies.
