Context:
Police in Hyderabad arrested four persons for allegedly abandoning several Siberian Huskies and other dogs in extreme summer conditions, leading to the death of one animal and critical health conditions for others. The case was registered under provisions of the Bharatiya Nyaya Sanhita (BNS) and the Prevention of Cruelty to Animals Act, 1960.
- The Prevention of Cruelty to Animals (PCA) Act, 1960 is the primary legislation aimed at preventing unnecessary pain or suffering to animals in India.
- The Act defines cruelty to animals to include abandonment, starvation, overloading, confinement, beating, poisoning and neglect.
- Section 11 of the PCA Act lists acts considered cruel treatment towards animals and prescribes penalties.
- The Animal Welfare Board of India (AWBI) was established under the PCA Act to promote animal welfare and advise governments on animal protection measures.
- Article 48A of the Directive Principles directs the State to protect wildlife and the environment, while Article 51A(g) makes compassion towards living creatures a Fundamental Duty.
- Bharatiya Nyaya Sanhita (BNS), 2023 contains provisions relating to killing, poisoning or maiming animals.
- Exotic dog breeds such as Siberian Huskies are adapted to cold climates and may suffer severe heat stress in tropical regions.
