Context:

While reviewing the scope of Article 30(1), which protects minority educational institutions, particularly concerning those that impart religious instruction, The Supreme Court has asked the Union Government to determine if such institutions should be treated as religious institutions under Article 26(a) rather than enjoying the greater autonomy granted by Article 30(1).

  • A petition argued that institutions mainly teaching religion should fall under Article 26(a) dealing with religious and charitable institutions, not under Article 30(1) or Article 19(1)(g).
