SC on Electoral Roll Exclusion and Voting Rights

Electoral Roll Exclusion and Voting Rights

Context: The Supreme Court held that voters excluded from electoral rolls during SIR do not permanently lose their voting rights. It emphasized completion of the adjudication and appeal process to ensure justice for affected voters.

  • Electoral rolls are lists of eligible voters prepared under the Representation of the People Act, 1950.
  • Special Intensive Revision (SIR) is conducted to update rolls by removing duplicates, dead voters, or ineligible names.
  • Article 326 provides for universal adult suffrage (18+ years). Election Commission ensures free and fair elections under Article 324.
  • Voter exclusion can be challenged through claims and objections process. Tribunals or designated authorities handle appeals against exclusion decisions.
