Supreme Court Strikes Down Maharashtra’s Methanol Rules (Source: The Hindu)

Context

The Supreme Court of India struck down Rules 18A and 18B of the Maharashtra Poisons Rules, 1972, ruling that the state’s rigid restrictions on industrial methanol were unconstitutional. While the government aimed to prevent toxic alcohol tragedies, the court found the measures disproportionately harmed legitimate trade without effectively curbing illicit liquor rackets.

Explanation

  • Dual Nature of Methanol: Methanol is a highly toxic, flammable liquid chemical predominantly used as an essential industrial raw material for manufacturing formaldehyde, resins, and plastics; however, it is frequently misused by bootleggers as a cheap, highly lethal adulterant in illicit liquor (hooch).
  • The Impugned Regulations: Rules 18A and 18B mandated that suppliers verify buyers held a specific poison license and enforced the compulsory blending of distinct colorants and bitterants into methanol to deter human consumption.
  • Industrial and Commercial Disruption: Because high-purity methanol is foundational for chemical synthesis, the forced addition of chemical dyes and bittering agents altered its chemical composition, rendering the raw material unusable for lawful manufacturing processes.
  • Constitutional Infringement: The Supreme Court declared the rules invalid under Article 14 (Right to Equality) and Article 19(1)(g) (Freedom of Trade and Profession), classifying the restrictions as manifestly arbitrary and an unreasonable restriction on lawful commerce.
  • Failure of the Proportionality Test: Applying the judicial proportionality framework, the court concluded that penalising law-abiding industries lacked a rational nexus to the objective, as altering legal industrial stock fails to address the root issue of illegal smuggling, theft, and black-market distribution.
