Parliamentary Privilege India and MCC Overlap Debate

Context:

Congress has moved a privilege notice against the Prime Minister over his April 18 address, alleging remarks undermining MPs’ integrity. Simultaneously, the Election Commission is examining complaints that the address violated the Model Code of Conduct during elections.

  • Parliamentary privileges are special rights and immunities enjoyed by Parliament and its members under Articles 105 (Parliament) and 194 (State Legislatures).
  • These include freedom of speech in Parliament and protection from legal proceedings for anything said within the House.
  • A breach of privilege occurs when these rights are violated or when actions obstruct the functioning, authority, or dignity of the House.
  • Contempt of the House includes any act that lowers the authority of Parliament or interferes with members’ duties.
  • Privilege motions/notices are raised by MPs and decided by the Speaker/Chairman, often referred to the Privileges Committee.
  • The Model Code of Conduct (MCC) is a set of guidelines issued by the Election Commission to ensure free and fair elections; it is not legally enforceable but has moral and political force.
  • MCC comes into effect from the date of election announcement and regulates conduct of political parties, candidates, and government.
  • It prohibits misuse of official machinery, public resources, and government platforms for electoral advantage.
  • The Election Commission of India is a constitutional body under Article 324, responsible for conducting elections and enforcing MCC.
  • Issues of overlap arise when executive actions during elections are scrutinized both for parliamentary propriety and electoral fairness.
