U.S. Proposes 12.5% Tariff Over Forced Labour Concerns (Source: The Hindu)

Context:

The U.S. has proposed a 12.5% tariff on imports from 54 countries, including India, over alleged failure to restrict goods made using forced labour. The proposal is part of a US investigation under Section 301 of the U.S. Trade Act, 1974.

Section 301 Tariffs and India’s Trade Compliance Challenge

Explanation:

  • Forced labour refers to work extracted from people under coercion, threat, debt bondage, trafficking or lack of free consent. In India Forced Labour is banned under Article 23 of the Constitution.
  • Countries increasingly use labour standards as part of trade policy and supply-chain regulation.
  • Section 301 of the U.S. Trade Act, 1974 allows the U.S. to investigate and respond to unfair trade practices by other countries. Tariffs are taxes imposed on imported goods and can make foreign products costlier in the importing country.
  • For India, the issue is important because it links trade access with labour regulation and export competitiveness.
  • Proposed additional 12.5% tariff on imports from India appears to be imposed not because of forced labour inside India, but because India lacks a strict ban on importing goods made with forced labour from third countries (such as China). E.g India imports raw materials for Solar Panels from China, Make Solar Panels in India and export them to USA.
