Supreme Court Restricts Use of Special Intensive Revision (SIR) Data to Electoral Purposes (Source: The Hindu)

Context: The Supreme Court has issued notice to the Election Commission of India (ECI) and the West Bengal Government over allegations that data from the Special Intensive Revision (SIR) of electoral rolls is being used to deny welfare benefits and cancel caste certificates. The Court reiterated that SIR data is meant solely for electoral purposes and cannot be used to determine citizenship or for non-election administrative actions.

Special Intensive Revision and Electoral Data Limits

Explanation

  • Special Intensive Revision (SIR) is a comprehensive revision of electoral rolls conducted by the Election Commission of India (Article 324) to ensure voter lists are accurate and updated.
  • Inclusion in an electoral roll is governed by the Representation of the People Act, 1950, while citizenship is determined only under the Citizenship Act, 1955.
  • The ECI has no authority to adjudicate citizenship; doubtful citizenship cases must be referred to the competent authority under the Citizenship Act.
  • Electoral roll deletion affects only the right to vote and cannot automatically deprive individuals of food security, welfare benefits, caste certificates, or other statutory entitlements.
  • The Supreme Court emphasized that electoral data cannot be used for non-poll administrative purposes, safeguarding constitutional rights under Articles 14, 21 and 326.
