UAPA Bail Norms and the Article 21 Balance

Context:

The Supreme Court has again discussed the question of bail under the Unlawful Activities (Prevention) Act, 1967, especially where trials are delayed and the accused remains in jail for long periods. The issue highlights the balance between national security and personal liberty under Article 21.

  • UAPA, 1967 is India’s main anti-terror law, used to deal with unlawful activities, terrorist acts, terror funding and membership/support of banned organisations.
  • It allows the government to declare individuals or organisations as terrorist or unlawful.
  • Bail under UAPA is stricter than ordinary criminal law because of Section 43D(5).
  • Under Section 43D(5), bail may be denied if the court finds that accusations are prima facie true.
  • Normally, Indian criminal law follows the principle: “bail is the rule, jail is the exception.”
  • This principle flows from Article 21, which protects life and personal liberty.
  • However, special laws like UAPA, NDPS Act and PMLA impose stricter bail conditions.
  • Courts have held that prolonged incarceration and delayed trial can violate Article 21.
  • Therefore, even under UAPA, bail may be granted if trial delay makes detention unreasonable.
  • The key issue is balancing state security, due process, speedy trial, presumption of innocence and liberty.
