Context

The Supreme Court has sought the Union government’s response to a petition challenging the Prevention of Insults to National Honour (Amendment) Act, 2026 and directions concerning Vande Mataram. The Court orally observed that genuine conscientious / religious objection to singing should not invite criminal consequences, referring to the Bijoe Emmanuel v. State of Kerala (1986) case precedent.

Explanation

  • The primary debate centers on the conflict between state-mandated patriotism and fundamental religious freedoms, specifically whether the government can legally criminalize the refusal to sing the National Song, Vande Mataram.
  • Vande Mataram, composed by Bankim Chandra Chattopadhyay, is honoured as India’s National Song; the Constituent Assembly on 24 January 1950 accorded it equal honour with Jana Gana Mana.
  • The Prevention of Insults to National Honour Act, 1971 protects national symbols, including the National Flag and National Anthem.
  • The 2026 Amendment to the above Act extended protection to the National Song, penalising intentional prevention of its singing or disturbance of an assembly singing it.
  • Articles 25 and 26 protect freedom of conscience and religion, subject to constitutional limitations.
  • In Bijoe Emmanuel v. State of Kerala (1986), the Supreme Court protected students who respectfully stood but declined to sing the National Anthem because of genuine religious belief.
  • The present case concerns the balance between national symbols, freedom of conscience and constitutional secularism; the constitutional challenge remains pending.
