Uniform Excise Laws and Liquor Packaging Regulation

Context:

The Supreme Court has flagged the lack of uniformity in State excise laws, especially regarding the definition of a liquor “bottle”. The issue concerns deceptive liquor packaging, where cheap alcohol is allegedly sold in cartons or sachets resembling fruit juice, raising public health and safety concerns.

  • Excise laws deal with the regulation and taxation of goods such as liquor, alcohol-based products and narcotic substances. In India, liquor regulation is largely under the control of State governments.
  • Under the Constitution, alcohol for human consumption falls mainly under the State List, so each State frames its own excise law, licensing rules, packaging norms and tax structure.
  • Because every State has its own excise framework, there is no complete uniformity in definitions such as “bottle,” “container,” “package,” “sachet,” “carton,” or “wrapper.”
  • This legal variation can create loopholes where liquor may be sold in unusual or attractive packaging, sometimes resembling fruit juice or soft drink cartons.
  • Such packaging raises concerns of deceptive marketing, especially when bright colours, fruit names or juice-like visuals are used to make alcoholic products look harmless.
  • The issue is linked to public health, as alcohol products without clear warnings may encourage underage consumption, casual drinking, and irresponsible use.
  • It also creates law enforcement problems, because small cartons, pouches or sachets may be easier to transport, conceal, smuggle or consume in public spaces.
  • The Supreme Court’s concern is not merely about taxation, but about standardisation, consumer protection, health warnings, responsible regulation and public safety.
