- UAPA, 1967 is India’s main anti-terror law used to deal with unlawful activities, terrorist acts, terror funding and membership/support to banned organisations.
- Under Section 43D(5) of UAPA, bail is difficult if the court finds that accusations are prima facie true.
- This creates a stricter bail standard than ordinary criminal law under the Criminal Procedure Code / BNSS.
- Normally, criminal law follows the principle of “bail is the rule, jail is the exception.”
- In UAPA cases, national security concerns often shift the balance towards stricter pre-trial detention.
- However, constitutional courts have also stressed that prolonged incarceration without trial may violate Article 21, which protects life and personal liberty.
