Context

The UCC debate is often framed primarily through religion, personal laws and minority rights, which can overshadow its equally important gender implications. As more States consider UCC frameworks, the key question is whether legal uniformity will actually improve women’s rights in marriage, divorce, maintenance, inheritance, property and intimate relationships, while protecting privacy and dignity.

Explanation

1. Uniformity Must Produce Real Equality

  • Giving everyone the same legal rule may not ensure equality when social and economic power is unequal.
  • Example: a daughter may legally receive an equal inheritance but may face family pressure to relinquish her share.
  • Hence, a UCC must secure actual access to rights, not merely formal equality.

2. Economic Security After Marriage Breakdown

  • Deserted or divorced women may lack independent income after years of unpaid childcare and domestic work.
  • Maintenance should therefore be quick, enforceable and sufficient, especially where one spouse is economically dependent.
  • Matrimonial property rules could recognise unpaid care when dividing assets accumulated during marriage.

3. Protection of Vulnerable Partners

  • Women in invalid or disputed marriages, including a second wife who entered a marriage without knowing about an existing spouse, may otherwise lose maintenance and property protection.
  • A gender-just code should protect individuals who entered relationships in good faith, instead of leaving them without remedies.

4. Live-in Relationships: Protection vs Privacy

  • Uttarakhand requires registration of live-in relationships.
  • Registration may help establish responsibilities concerning partners and children.
  • However, excessive disclosure or criminal penalties can raise concerns about privacy, autonomy and social exposure, particularly for women.

5. Accessible Divorce and Justice

  • Requiring every marital dispute to pass through lengthy litigation can burden both families and courts.
  • Mutual-consent separations could have simpler procedures, while courts handle contested maintenance, custody, violence and property disputes.

6. Reform Must Address All Inequalities

  • Reform should examine inequalities in inheritance, maintenance, matrimonial property and family-based economic privileges, irrespective of the community in which they occur.
  • Broad consultation with women, tribal groups, minorities and other affected communities can prevent unintended discrimination.

Conclusion

A successful UCC should not be judged merely by whether India has one law, but by whether that law ensures dignity, gender justice, economic security, privacy and accessible remedies while respecting India’s social diversity.
