Context
The Delhi Police has withdrawn Jantar Mantar’s designation as an authorised protest venue and designated Ramlila Maidan, Burari Ground and CBD Ground as alternative sites. Activists have opposed the decision, citing Jantar Mantar’s proximity to Parliament and government offices.
Explanation
- Jantar Mantar, located in New Delhi, has historically served as an important venue for peaceful protests and public demonstrations.
- Article 19(1)(a) guarantees freedom of speech and expression, while Article 19(1)(b) guarantees the right to assemble peaceably and without arms.
- These rights are subject to reasonable restrictions under Articles 19(2) and 19(3), respectively, including public order considerations.
- Article 19(1)(c) guarantees the right to form associations or unions.
- In Mazdoor Kisan Shakti Sangathan v. Union of India (2018), the Supreme Court emphasised balancing peaceful protests with residents’ rights and public convenience.
- The Delhi Police’s revised standing order replaces Jantar Mantar with three designated protest grounds.
- Denotification removes its status as a designated protest venue; it does not automatically prohibit every form of peaceful assembly there.
