Context
Recently, the Central Consumer Protection Authority (CCPA) intensified action against food companies using “100%” claims, as they may create a misleading impression of absolute purity or completeness. The FSSAI has also advised food businesses to discontinue such claims on labels, packaging and promotional material.
Explanation
- CCPA is the apex regulatory authority established under Section 10 of the Consumer Protection Act, 2019 and became operational in 2020.
- It protects the rights of consumers as a class against unfair trade practices and false or misleading advertisements.
- It can initiate inquiries suo motu, on complaints or on Central Government directions; investigations are conducted through its Investigation Wing headed by a Director-General.
- Under Section 21, it can order misleading advertisements to be discontinued or modified and impose penalties on manufacturers, traders and endorsers.
- It can also order recall of unsafe goods, withdrawal of unsafe services and reimbursement of prices.
- FSSAI, established under the Food Safety and Standards Act, 2006, regulates food safety, labelling and related claims.
- Thus, CCPA focuses on consumer protection, while FSSAI specifically regulates food safety and standards.
