Context
The Supreme Court has sought the Centre’s response on petitions challenging the Digital Personal Data Protection (DPDP) Act, 2023 for allegedly weakening the Right to Information framework. The Court will examine whether the amended law creates excessive protection for personal information at the cost of transparency.
Explanation
- The Right to Information (RTI) Act, 2005 promotes governmental transparency and flows from Article 19(1)(a).
- Earlier, Section 8(1)(j) protected private information but permitted disclosure where larger public interest justified it.
- Section 44(3) of the DPDP Act replaced this with a broader exemption for information relating to personal information.
- However, Section 8(2) still permits disclosure when public interest outweighs the harm caused.
- The dispute involves balancing the right to information against the right to privacy under Article 21, recognised in the K.S. Puttaswamy judgment.
