Election of the Vice-President of India

Why in News?

C.P. Radhakrishnan was elected the 17th Vice-President of India, defeating Opposition Candidate Justice B. Sudershan Reddy by 152 votes. Out of 788 electors, 767 voted, with 15 invalid and 14 abstentions; cross-voting aided NDA’s victory.

Description:

Constitutional Provisions:

  • Article 66(1): Vice-President elected by the Electoral College consisting of members of both Houses of Parliament (Lok Sabha + Rajya Sabha), elected & nominated.
  • Article 66(2): Cannot be a member of either House of Parliament or State Legislature.
  • Article 67: Term – 5 years.
  • Article 68(2): In case of vacancy, election must be held promptly.

Election Procedure:

  • Nomination:
    • 20 proposers + 20 seconders.
    • Security deposit: 15,000.
    • Certified copy of name in current electoral roll required.
  • Voting:
    • System of Proportional Representation by means of Single Transferable Vote (STV).
    • Secret ballot.
    • Each MP’s vote = value 1 (unlike Presidential election where vote value differs).
  • Electoral College: Lok Sabha + Rajya Sabha (both elected + nominated members).
  • No Whip: Anti-Defection Law not applicable.

Eligibility (Article 66):

  • Citizen of India.
  • Minimum 35 years of age.
  • Qualified for election as member of Rajya Sabha.
  • Must not hold any office of profit under Union, State, or local authority.

Key Difference from Presidential Election:

  • President’s Electoral College: Elected MPs + elected MLAs (no nominated members).
  • Vice-President’s Electoral College: MPs of both Houses (elected + nominated); State Legislatures not involved.
