Extension of Commission on SC Status for Dalits Post-Conversion

Context:

The Union government has granted a third extension to the Justice K.G. Balakrishnan Commission, which is examining whether Scheduled Caste (SC) status can be extended to Dalits who convert to religions other than Hinduism, Sikhism, or Buddhism.

  • The Commission of Inquiry, chaired by former CJI K.G. Balakrishnan, was set up in October 2022 to examine granting SC status to Dalits who convert to Christianity or Islam.
  • The issue arises due to provisions of the Constitution (Scheduled Castes) Order, 1950, issued under Article 341. This originally restricted SC status only to Hindus, excluding converts to other religions.
  • Later amendments expanded eligibility:
  • Sikhs included in 1956
  • Buddhists included in 1990
  • As per the current legal position, conversion to religions like Christianity or Islam leads to loss of SC status.
  • The Supreme Court (March 2026) reiterated that SC status is limited to Hindus, Sikhs, and Buddhists, and conversion results in immediate loss of caste-based benefits.
  •  Petitioners (Dalit Christians) argue that denying SC status after conversion violates:
  • Right to equality (Article 14)
  • Freedom of religion (Article 25)
  • The Commission has been consulting stakeholders, including Dalit Christian and Muslim organizations, but has not yet submitted its final report.
