Context
Recently, the Enforcement Directorate (ED) conducted searches at 30 locations across Tamil Nadu, Kerala, Karnataka and Telangana in eight narcotics-related cases. The searches, linked to the Nasha Mukt Bharat Abhiyaan, are examining the money-laundering and proceeds-of-crime angle in drug trafficking cases.
Explanation
- Narcotics Control Bureau (NCB) is the central agency for combating drug trafficking and coordinates enforcement of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985.
- The NDPS Act regulates and prohibits unauthorised production, possession, sale, purchase, transport and trafficking of narcotic drugs and psychotropic substances.
- Enforcement Directorate (ED) is a financial investigation agency under the Department of Revenue, Ministry of Finance.
- Drug trafficking can generate proceeds of crime; laundering such proceeds can attract investigation under the Prevention of Money Laundering Act (PMLA), 2002.
- Under PMLA, the ED can investigate money laundering and, subject to statutory conditions, search premises, provisionally attach property and seek confiscation through legal proceedings.
- Nasha Mukt Bharat Abhiyaan (NMBA), launched by the Ministry of Social Justice and Empowerment, focuses on reducing drug demand through awareness, prevention, education and community participation.
- Thus, India’s anti-drug framework combines supply reduction, financial investigation and demand reduction.
