Introduction:

The Jammu and Kashmir Reorganisation Act, 2019 bifurcated the erstwhile State into the Union Territories of Jammu & Kashmir and Ladakh, marking the first instance of a full-fledged State being downgraded into a Union Territory. The demand for restoration of Jammu and Kashmir Statehood has since evolved beyond administration into a test of democratic legitimacy and cooperative federalism.

Why Restoration of Statehood is a Democratic and Federal Imperative?

Restoring Democratic Trust:

  • Statehood enables an elected government with greater executive authority, strengthening representative democracy.
  • It fulfils assurances given by the Union Government and acknowledged by the Supreme Court, enhancing public confidence in constitutional institutions.
  • Greater political participation can reduce alienation and foster inclusive governance.
  • Strengthens accountability by empowering elected representatives over governance and public service delivery.

Reinforcing Constitutional Federalism:

Concerns and Challenges:

  • Delimitation, rehabilitation and regional representation remain politically sensitive issues.
  • Balancing security imperatives with democratic decentralisation will remain a key challenge.

Way Forward:

  • Restore Statehood at the earliest while ensuring robust security coordination.
  • Strengthen democratic institutions through regular local body and Assembly elections.
  • Promote inclusive development, dialogue and capacity-building to deepen public trust.
