Supreme Court on Religious Conversion and Caste-Based Reservation

Paper: GS-II – Polity & Social Justice    |    Subject: Polity    |    Topic: Rights issues    |    Issue: Religious Conversion and Reservation Eligibility

Context

On 15 October 2026, the Supreme Court upheld the Madras High Court’s decision striking down a Tamil Nadu government order allowing certain Hindu converts to Islam to obtain Backward Class (Muslim) certificates.

Central question: Can a person automatically carry their earlier caste-based reservation benefits into another religion?

Understanding Reservation and Religious Conversion
Explanation
What Was the Actual Dispute?

•  A Hindu man converted to Islam and sought a certificate identifying him as belonging to the recognised Muslim Lebbai backward community.

•  Tamil Nadu argued that religious conversion should not eliminate reservation benefits arising from existing social disadvantages.

•  The Supreme Court disagreed, distinguishing continued social backwardness from legal membership in a recognised backward class.

What Did the Supreme Court Rule?
A. Reservation Cannot Automatically Transfer Across Religions

•  Reservation attaches to a constitutionally identified backward class, not to an individual as a “transferable personal entitlement”.

•  Example: A Hindu OBC converting to Islam may remain poor and disadvantaged. However, conversion alone cannot establish membership in the Muslim Lebbai community.

B. Religion and Social Community Are Different

•  Islam emphasises equality, but Indian Muslim society historically exhibits social stratification, including Ashraf, Ajlaf and Arzal groupings.

•  Recognised Muslim backward communities have distinct historical, occupational and social identities.

•  Therefore, conversion establishes religious affiliation, not automatic membership in a particular backward community.

C. Authorities Must Verify Eligibility

•  A Jamath (Muslim religious body) may certify conversion but cannot independently determine backward-class status.

•  Competent government authorities must establish eligibility. Even reconversion to Hinduism requires factual verification before earlier caste status can be restored.

Broader Significance

•  Constitutional: Reinforces Articles 14, 15(4), 16(4) and 341.

•  Sociological: Religious conversion may change legal identity without eliminating historical caste inequalities.

•  Administrative: Prevents automatic community classification while preserving legitimate reservation claims of recognised Muslim backward communities.

Conclusion

The judgment distinguishes social disadvantage from legal reservation eligibility. While caste-based inequalities may survive religious conversion, reservation requires legally recognised community membership rather than religious conversion or past disadvantage alone.
