Introduction:

The principle of free and fair elections, affirmed in Indira Nehru Gandhi v. Raj Narain case, is part of the basic structure doctrine evolved in Kesavananda Bharati v. State of Kerala. 

Electoral rolls are the foundation of this principle, as they determine who can exercise the right to vote under Article 326 of the Constitution of India. Hence, any large-scale deletion of voters raises serious constitutional and legal concerns.

Constitutional and Legal Issues:

1.    Violation of Universal Adult Suffrage (Article 326):

Article 326 guarantees voting rights to all citizens above 18 years, subject to limited disqualifications.
Mass deletions risk excluding genuine citizens, thereby undermining this constitutional mandate.

2.   Scope and Limits of ECI’s Powers (Article 324):

Article 324 empowers the Election Commission to supervise and conduct elections.
However, these powers are not absolute and must operate within the framework of existing laws.
If the ECI prescribes documents for citizenship proof, it may overstep into the domain of the executive, which administers citizenship laws.

3.   Conflict with Statutory Framework:
The Representation of the People Act, 1950 and Registration of Electors Rules, 1960 govern electoral rolls.
These laws distinguish between:
Summary revision before elections
Intensive revision when elections are not imminent
Conducting SIR close to elections may violate statutory intent and procedural safeguards.

4.   Violation of Principles of Natural Justice:
Deletion of names without prior notice or opportunity to be heard violates:
Audi alteram partem (right to be heard)
Such actions are arbitrary and legally vulnerable.

5.   Arbitrariness and Rule of Law (Article 14):
Use of non-statutory categories like “logical discrepancy” lacks legal basis.
Arbitrary classification and deletion may violate Article 14 (equality before law) and the rule of law doctrine.

6.   Impact on Free and Fair Elections:
Large-scale deletions can:
Distort electoral outcomes
Disproportionately affect vulnerable sections (poor, migrants, rural populations)
This undermines the level playing field essential for democratic legitimacy.

7.    Federal and Institutional Concerns:
Citizenship determination is linked to laws administered by the Union executive.
Any unilateral action by ECI in this domain raises institutional overlap and accountability issues.

Critical Assessment:
While periodic revision of electoral rolls is necessary to remove duplicates and ineligible entries,
The process must be: Transparent, Legally grounded, Procedurally fair
Excessive or poorly conducted deletions risk converting a corrective exercise into a tool of disenfranchisement.

Conclusion:
Free and fair elections require not only efficient administration but also inclusion, legality, and fairness in electoral processes. Ensuring strict adherence to constitutional principles, statutory provisions, and natural justice is essential to safeguard democratic integrity and public trust in elections.
